I just bought one in the bazaar on The Rathe for 150p....was the only one up at the moment so I am not sure if I just got lucky or what :)

Found 2 of them on a merchant in PoT, I think it was near the bank. Check them all, there's only 4 or 5 merchants there? 100pp with 76 cha, equipped mugs and paid 83pp each. Gave one to a guildie. Checked bazaar, cheapest was 125pp. Paid 4k for the horn, had the other 2 items from a full day xping in PoI. Had AA xp at 100%, got nearly 2 full blues from first turn-in, very little from second, at lvl 57. Nice cloak, I swap this and my spiked seahorse hide belt onto my 19 monk when i want to play him lol

I have heard from two web sites that these things can be bought at merchants and i would really like to know where. so if anyone could let me know please do. thanks :-)

If someone sold one of these to a merchant, the merchant would then have one to re-sell. (Granted they would be foolish to do so, but you know what? Some foolish people DO play EQ) Therefore said merchant(s) could be anywhere.

I bought no less than 5 on a single vendor in PoK once and sold the lot in the Bazaar for an average of 2K each.
Altgether I have probably bought about a dozen of them - they aren't all that rare on PoK vendors.
The Gold Tipped Boar Horn is harder to find, but again I must have had 8 or 9 of those so far.

This drops off giants in the west wing in BoT, was in there for about 2 hours yesterday and 4 dropped, which was pretty damn good. Goes for 3k on Luclin server.

It is indeed tradeable and statless. Gave one to a friend just last night.
