It looks like this was first added to the item table during LDoN during the revamp for Howling Stones, so I've changed the expansion on it.

I killed him January 16th 2004 in the entrance to the zone where u gate in. He is a puss, singled pulled and 61 air tore him up, he dropped impaler. I did not relaize he is level 54 I would guess from damage and DS that he is close to 25-30k but slow.

He has less than 10k, 6 ticks of horror and darkness, and 3 lifetaps, he dead.
Are the stats without being level 40?
There is no required level, thus anyone can wear it. The recommended level of 40 acts like a Charm... If you're under 40, the stats will be granted in the same percentage as your level in relation to level 40. If you're 20 all stats are halved; 30 = 75%, etc. Effects have their own level requirements, of course but they either work or don't work.

It doesn't appear that way. If the person looking at it were below the recommended level the true stats would appear in parentheses and be in red text.
Truer question, can a toon lower than 40 wear it? May not be able to put it in slot??

Yes the toon could wear, the toon would just not get the full effects.
