What level do you have to be to Right-Click the spear? 46 like the JBB?
Unless someone has ever clicked on it and had it give you the "your will is insufficent to command this weapon" message, then it's moot. I doubt this has happened. (If someone out there has had this problem, let us KNOW!)
I imagine it doesn't have a minimum level, since it's both NO DROP and requires an Epic quest to get.

If I am not misinformed this is the epic weapon for shamen. Since you can't do the quest until you are level 50 and the spear is No Drop, it doesn't really matter if you could have right-clicked it before lvl 50 because none below 50 will have it. But, to answer your question, you can right-click it at lvl 50.

50 is not the limit on level to obtain the spear of fate, it is 46. There is no part in the quest that requires you to be 50+, not many guilds will help you unless your 50+, but you still can do it before lvl 50.

You have to be level 50 for the quest because otherwise the NPCs won't respond to your handing in items. They will take your items and say thanks then ignore you. And the jbb proc level is 45 like all of the JB stuff.
Sorry, but you're just wrong. You only have to be 46 to complete this quest (but you better have some high powered friends), and this is only because you have to go to the Plane of fear.

Had to reply on this..
You can do the quest earlier than 46 to if you like to.. The tear can be MQ´d earlier.. I dunno about if you cant use the effect before 50 though..
